New York taxes the wages you earn there as a nonresident. New Jersey taxes you on everything as a resident, then gives you a credit for tax paid to New York. Getting that credit right, and knowing when New York’s claim reaches further than it should, is where most of the money is.## The convenience of the employer ruleNew York treats days you work from home in New Jersey as New York workdays if you work remotely for your own convenience rather than because your employer requires it. For most hybrid and remote employees of New York companies, that means New York taxes nearly all of their wages. New Jersey adopted a mirror-image rule in 2023 for New York residents working for New Jersey employers. The exception is a “bona fide employer office” at home, which New York defines narrowly. If your employer genuinely requires you to work from New Jersey, or you have no assigned New York office, your days may be sourced differently. We review your facts and document a position where one exists.## How the resident credit actually worksNew Jersey’s credit for taxes paid to other jurisdictions is limited to the New Jersey tax on the same income. In practice you pay roughly the higher of the two states’ tax on that income. The credit calculation is easy to get wrong, especially when RSUs, bonuses or investment income are involved, so we calculate it line by line.## What we handle- New York nonresident (IT-203) and New Jersey resident (NJ-1040) returns, with the credit calculated line by line.
- Allocation of wages, bonuses and RSU income by workday, including vesting periods that span different work arrangements.
- Withholding reviews so you aren’t over-withheld in one state and under-withheld in the other.
- Part-year returns for moves between New York and New Jersey, and statutory-residency analysis if you keep a New York apartment.
- Representation in New York residency and allocation audits.## If you keep a home in New YorkSpending more than 183 days in New York while maintaining a “permanent place of abode” there for substantially all of the year can make you a New York statutory resident, taxed on all your income, even if your domicile is New Jersey. New York audits this aggressively. Day logs, travel records and phone data matter, and we help clients keep them in a form that holds up.## Frequently asked questions### I work from home three days a week for a Manhattan company. Do I owe New York tax on those days?Usually, yes. Unless your employer requires you to work from New Jersey or your home office meets New York’s bona fide employer office test, New York sources those days to New York. New Jersey then gives you a credit, limited to the New Jersey tax on that income.### Do I need to file in both states?Yes. You file a New York nonresident return to report and pay New York tax, and a New Jersey resident return reporting all income and claiming the credit. There is no reciprocity agreement between the two states.### My RSUs vested after I moved from New York to New Jersey. Which state taxes them? Both may, in part. New York generally allocates RSU income based on where you worked between grant and vest. We calculate the allocation and make sure New Jersey’s credit matches it.### Can I challenge New York’s convenience rule?It is possible but rarely successful; New York has defended the rule successfully in its courts and tax tribunal. The better path is usually to make sure your employer’s arrangement and your records support the correct sourcing from the start.Talk it through with a CPAA free 45-minute strategy session with an experienced CPA.
